Welcome to Continue.Mobi ("Service"), operated by Eastgate Software Engineering ("Company", "we", "us", or "our"). By accessing or using our Service, you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use our Service.

1. Description of Service

Continue.Mobi is a phone-based authentication and identity verification service that allows users to sign in to third-party applications using one-time passwords (OTP) sent via SMS or email. The Service acts as an OAuth 2.0 identity provider for registered client applications.

2. Eligibility

You must be at least 18 years of age or the age of majority in your jurisdiction to use this Service. By using the Service, you represent and warrant that you meet this requirement and have the legal capacity to enter into these Terms.

3. Account Registration and Security

• Your account is identified by your mobile phone number. You are responsible for maintaining access to this phone number.
• You must provide accurate and current information when using the Service.
• You are responsible for all activity that occurs under your phone number and associated sessions.
• You must immediately notify us if you believe your account has been compromised.
• We reserve the right to suspend or terminate accounts that we reasonably believe have been compromised or are being used fraudulently.

4. One-Time Passwords (OTP)

• OTP codes are valid for a limited time period and are for single use only.
• You must not share your OTP codes with any other person.
• Standard SMS or data charges from your mobile carrier may apply when receiving OTP codes.
• We are not responsible for delays in OTP delivery caused by your mobile carrier or network issues.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws or regulations.
• Attempt to gain unauthorized access to any part of the Service, other accounts, or systems.
• Use automated tools, bots, or scripts to interact with the Service without our prior written consent.
• Attempt to bypass rate limits, security measures, or access controls.
• Interfere with or disrupt the integrity or performance of the Service.
• Use the Service to send unsolicited messages or engage in spamming activities.
• Impersonate another person or misrepresent your identity.

6. Rate Limiting and Account Restrictions

To protect the security and availability of the Service, we enforce rate limits on login attempts, OTP requests, and API usage. Excessive or suspicious activity may result in temporary or permanent restrictions on your account, including automatic blocking of your phone number.

7. Third-Party Applications

• The Service enables authentication with third-party applications ("Client Applications") that have registered with our platform.
• We are not responsible for the content, privacy practices, or terms of service of Client Applications.
• By authorizing a Client Application, you consent to sharing your phone number and basic profile information with that application.
• You may review and manage your connected applications through the Service.

8. Intellectual Property

The Service, including its design, features, logos, and content, is owned by the Company and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the Service without our express written permission.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, REVENUE, PROFITS, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

11. Indemnification

You agree to indemnify and hold harmless the Company, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the Service or violation of these Terms.

12. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service will immediately cease. Provisions that by their nature should survive termination shall remain in effect.

13. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective when posted on this page with an updated effective date. Your continued use of the Service after changes are posted constitutes acceptance of the modified Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of the Philippines, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in the Philippines.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
